A former Johnson County Sheriff's Office deputy faces a felony rape charge, accused of assaulting someone who was unconscious or physically powerless.
Justin Patrick Ramirez, 44, of Spring Hill, was charged with rape in Johnson County District Court on Friday, Sept. 25, the Kansas City Star first reported. The criminal complaint alleges Ramirez had sexual intercourse with a victim who was "unconscious or physically powerless" on Monday, Aug. 3.
Ramirez had worked as a Johnson County Sheriff's Office deputy since April 2016. The sheriff's office placed him on administrative leave on Wednesday, Aug. 26, and fired him on Sept. 25, the same day he was arrested, according to JCSO spokesperson Kristen Boxman.
The alleged rape was reported to the Overland Park Police Department, which investigated the case and arrested Ramirez, according to the Johnson County Post. Court documents filed by Ramirez's attorney state the assault was not reported to police until three weeks after it allegedly occurred.
A warrant was issued for Ramirez's arrest on Sept. 25. He turned himself in at the Johnson County Sheriff's Office Central Booking Facility at 101 N. Kansas Ave. in Olathe at 4:21 p.m. that day, according to the Johnson County Post.
Ramirez remained in custody on a $500,000 bond from Sept. 25 until his first court appearance on Monday, Sept. 28. His attorney argued the bond was set at twice the appropriate amount and that Ramirez could not post it. A judge granted a reduction to $50,000.
He was released that evening. Ramirez posted the $50,000 bond through a bail bondsman and left custody at 5:35 p.m. on Sept. 28, according to jail logs cited by the Johnson County Post.
His bond conditions include GPS monitoring, house arrest, no contact with the victim and no firearms, alcohol, illegal drugs or controlled substances, according to court records cited by the Kansas City Star. Ramirez's attorney argued he is not a flight risk, noting his family lives in the Kansas City area. Ramirez also agreed to surrender his passport, though it was not a required condition.
Court records show Ramirez has no prior criminal history. He grew up in the metro area, graduated from Shawnee Mission North High School and served four years in the U.S. Marine Corps, according to court documents.
Boxman, the JCSO spokesperson, said in a statement that the sheriff's office holds all employees to high standards of lawful, ethical and professional conduct on and off duty and that violations will not be tolerated.
Ramirez's next court appearance is scheduled for Thursday, Oct. 15, at 11 a.m.
